Pese a tanto día de la mujer, pese a tanta política de igualdad y a tanta paridad, la situación social de las mujeres no es buena en absoluto. Es cierto que relativamente está mejor que hace 10, 20, 50 o 100 años, pero no es buena. No sólo aumentan los casos de violencia machista, sino que no parecen tener remedio las situaciones de desigualdad salarial y de poder en el mundo laboral, la desigualdad en el ámbito político o en el mundo académico. El gobierno ha enviado al Parlamento una nueva ley de paridad, señal de que la situación social merece medidas correctoras.
En Todas está disponible el texto completo del anteproyecto de esta ley que se denomina "Ley Orgánica de Igualdad entre Mujeres y Hombres".
Su artículo 1.1 señala que "Esta Ley tiene por objeto hacer efectivo el principio de igualdad de trato y de oportunidades entre mujeres y hombres, en particular, mediante la eliminación de la discriminación de la mujer en cualesquiera ámbitos de la vida y, singularmente, en las esferas política, civil, laboral, económica, social y cultural para, en desarrollo de los artículos 9.2 y 14 de la Constitución, alcanzar una sociedad más democrática, más justa y más solidaria." Salvo en la vida religiosa, en la que nadie se mete, la ley se propone actuar en todos los aspectos de la vida. Por su parte, Mujeres en Red destaca los puntos más importantes de la ley, especialmente en materia laboral y en la regulación del acoso sexual tan frecuente en las empresas.
Es notable la obligación de realizar informes de impacto de género en las medidas económicas y sociales emprendidas por los poderes públicos, así como la obligación de las estadísticas públicas a desagregar los datos por sexos (¡bravo!) o de mantener la paridad en las listas electorales (lo que será un serio problema para los partidos políticos). No voy a entrar en detalles sobre esta ley, pero sí destacar que trata de derogar y corregir todas las otras leyes que mantienían o sancionaban situaciones de desigualdad, al tiempo que las modifica también en sentido de incrementar la igualdad, como es el caso de la recomendación de la paridad de sexos en los consejos de administración de las empresas o en la regulación de los permisos de maternidad y lactancia.
Aplaudiendo todas estas iniciativas legislativas que, en general, me parecen positivas para la mejora efectiva de las situaciones de discriminación real que se siguen manteniendo en España, soy sin embargo escéptica respecto a su eficacia. Es una ley que satisface a los colectivos y organizaciones feministas pero no sé si va a satisfacer a todas las mujeres y, sobre todo, me caben muchas dudas respecto a que cambie realmente la realidad social. Puede sonar carca y retrógrado lo que voy a decir, puede que me crucifiquen (sólo dialécticamente, espero), pero percibo en mi entorno una indiferencia absoluta hacia esta ley por la parte femenina. Mis alumnas, por ejemplo, no se habían enterado de su existencia y, una vez enteradas, no se sentían implicadas por ella. En la calle, en sondeos no representativos ni científicos, la reacción mayoritaria era que ya se buscarán los medios para seguir pagando menos a las mujeres y para preferir, las empresas, contratar hombres y dejar fuera a las mujeres casadas o con relaciones estables de pareja que "corren el peligro" de quedar embarazadas. Eso por no hablar de la cantidad de mujeres que prefieren seguir siendo desiguales: inferiores, protegidas y, a ser posible, mantenidas.
Los cambios en la feminidad por los que luchan las feministas implican cambios en la masculinidad, porque las relaciones entre los sexos son un sistema recíproco e interdependiente. Las leyes están bien, sobre todo en la medida en que permitan mejorar o corregir situaciones injustas. De ahí a que logre la igualdad entre hombres y mujeres va un buen trecho. La "igualdad", cuando se entendió como derecho al acceso a la educación y al mercado laboral, acabó en la triste historia de la doble jornada y en la dura vida de las supermujeres.
Día Internacional de la Mujer: felicito a las feministas por sus inciativas y les agradezco en el alma su dedicación a la mejora de las condiciones de vida de las mujeres. Pero sería de desear que el 8 de marzo fuera festivo para todas las mujeres. Ello nos permitiría gozar realmente de "nuestro" día.
